Agreement upon Check Out

By purchasing a digital image from hanelyWphotography you are agreeing to be bound by these Terms and Conditionsof Use.  Please read this agreement before you download or purchase any image.

Acceptable Use

After purchasing a digital image(s) may be used for personal,non-personal use only. The digital image may be used by one person of family(the purchaser) for printing for personal use or display.  The purchased image file may be temporarily transferred via digital media to be printed for personal use by a professional printer.

Usage Limitations

No digital images or prints may be shared or copied.

No image or prints may be sub-licensed, resold, distributed, or otherwise made available for use or distribution.

You may not alter an image obtained from hanelyWphotography remove hanelyWphotography's copyright information imbedded in the digital image file.

If you are interested in using any images for commercial purposes contact Hannelie vd Merwe.  The pricing and terms of commercial use will be established by mutual agreement at that time.  Any digital image by Hannelie vd Merwe, purchased or obtained from the website, or any other portion of an image, may not be used without consent in any final materials distributed to the public for advertising and marketing materials or any on-line ,broadcast or other electronic distribution system, communication, web pages, marketing or promotional materials, multimedia projects, video, graphic design projects, and general creative works, and may not be distributed, sub-licensed or made available for use or distrubution separately or individually.

Grant of License

Hannelie and hanelyWphotography grants to you use of purchase digital images (commonly delivered via email attachment) subject to the Acceptable Use, Usage Limitations, and Unauthorized Usage.  No rights are granted until payment is received in full.

hanelyWphotography retains full rights to her digital images.  You may not transfer or duplicate images without prior payment and written concent.

Limited Warrenty

hanelyWphotography warrents that for a period of 90 days from the date of delivery of the digital image(s), as evidenced by your receipt, that the digital image, under normal use , will be free from defects.  hanelyWphotography's liability, and your remedy, under this warranty, will be Hannelie vd Merwe's option to replace the digital image, or to refund the purchase price and terminate this agreement.

Termination of Agreement

This Agreement will automatically terminate upon failure by you, the licensee, to comply with any of its terms.  If this happens, you hereby agree to detroy all copies and archives of the hanelyWphotography digital images, to cease using the images for any purpose, and to confirm to Hannelie vd Merwe in writing that you have complied with these requirements.

hanelyWphotography and Hannelie vd Merwe reserves the right to commence legal proceedings if copyright infringment has ensued from unauthorized use of hanelyWphotography's digital images.
